McCulloch v. Maryland has been characterized as among the most important cases in the history of the Supreme Court, with one study rating it as the Court’s single most influential opinion. Did Congress have the power to create the Second Bank of the United States? And if the Bank was indeed constitutional, could the state of Maryland levy a tax on the banknotes it issued? The Court’s opinion was both praised and condemned in a dialogue that continues to this day, asking critical questions about the nature and scope of federal power, the reserved rights of sovereign states, and the proper role of federal courts, which Chief Justice John Marshall reminded us “[we] must never forget is a constitution we are expounding.”

Sanford Levinson holds the W. St. John Garwood and W. St. John Garwood, Jr. Centennial Chair in Law, at the University of Texas Law School. He is also a Professor in the department of government at the University of Texas. Levinson is the author of approximately 400 articles, book reviews, and commentaries in professional and popular journals — and a contributor to the popular blog Balkinization.  He has written six books, most  recently with his daughter, Cynthia Levinson, Fault Lines in the Constitution: The Framers, Their Fights, and the Flaws that Affect Us Today. He received the Lifetime Achievement Award from the Law and Courts Section of the American Political Science Association.

The lecture will be held at the Supreme Court of the United States, One First Street NE, Washington, DC. Due to security requirements, government­issued photo identification such as a driver’s license or passport, must be presented for admittance to the lecture. Registration will close 24 hours prior to the lecture.  Advance reservation is required, seating is limited.
